Legal Basement Suite in Saskatoon

Full-Service Secondary Suite Builds, Permit Process Included

A legal basement suite is a self-contained secondary dwelling unit that meets National Building Code requirements along with City of Saskatoon zoning and permit rules. That distinction matters: an illegal or non-conforming suite can’t be rented without liability exposure, may not satisfy lenders counting rental income toward mortgage qualification, and may need to be dismantled if discovered. We’ve been building and renovating homes in Saskatoon since 1967, and our basement renovation services include transforming lower levels into fully finished legal suites with a private kitchen, bathroom, and laundry hookups, built to city requirements from the ground up.

Homeowners pursue legal basement suites for rental income, multi-generational living arrangements, or to strengthen a mortgage application with secondary income. Whatever your reason, we handle the construction and the compliance process together so you don’t have to manage both separately.

What Makes a Basement Suite Legal in Saskatoon

Before any work begins, your property’s zoning designation under the City of Saskatoon Zoning Bylaw determines whether a secondary suite is permitted at all. Not every zoning district allows them: secondary suites can’t be added to two-unit dwellings, rowhouse or townhouse dwellings, or dwelling groups. Only one secondary suite is permitted per property regardless of lot size.

A legal secondary suite permit requires scaled construction drawings, including a site plan and floor plans showing both the existing home and the proposed suite. We manage the permit process for our clients, including preparing drawings, submitting permit applications, and coordinating the required city inspections. Our Process Makes Perfect client experience model keeps the project on schedule from initial design through final inspection, so the compliance side of the project doesn’t slow down the construction side.

Building Code Requirements for a Legal Suite

Saskatoon’s secondary suite standards involve specific construction requirements across several categories. Understanding them upfront helps set realistic expectations for scope and budget.

Ceiling Height & Egress Windows

Suite rooms and hallways require a minimum ceiling height of approximately 6 feet 5 inches (1.95 m). Every bedroom must include an egress window sized to allow emergency exit, with an unobstructed opening of at least 0.35 square meters and no single dimension smaller than 380 mm (15 inches). Many existing basements require window well excavation and new window installation to meet this requirement.

Fire Separation & Soundproofing

A smoke-tight barrier between the principal dwelling and the suite is required to control fire and smoke spread, built with drywall and sealed penetrations throughout. The City of Saskatoon also requires a minimum Sound Transmission Class (STC) rating of 43 between units. STC is a standardized measure of how much airborne sound a barrier reduces; an STC-43 assembly can substantially limit noise transfer between floors, which matters for both tenants and the homeowners above.

Independent Mechanical Systems

This is where legal suite projects become technically demanding, and where our in-house team makes the most practical difference. A legal secondary suite requires its own independent heating source, and air can’t circulate between the suite and the principal dwelling, which rules out extending the main home’s existing forced-air system. Options include a dedicated furnace, electric baseboard heaters, or in-floor radiant heat.

Ventilation must also be independent, typically through a dedicated Heat Recovery Ventilator (HRV), a mechanical system that exchanges stale indoor air for fresh outdoor air while recovering most of the heat. Smoke alarms in both units must be interconnected so that an alarm triggered in the suite sounds in the principal dwelling, and vice versa.

Our licensed plumbers and electricians install all of these systems in-house. There’s no coordinating with outside mechanical contractors or waiting on third-party availability to keep your project moving.

Legalizing an Existing Basement Suite

If your home already has a suite that was never permitted, the path forward depends on when it was built. The City of Saskatoon’s Legalizing Existing Suites (LES) program allows suites installed before January 1, 1999, to meet revised occupancy standards focused on life and health safety rather than the full current National Building Code. Suites built after that date aren’t eligible for the LES program and must fully comply with current National Building Code requirements.

Either path starts with a Bylaw Compliance inspection. The city reviews zoning, checks permit records, and inspects ventilation, stairwell configuration, and window and door specifications before identifying the work required to bring the suite into compliance. Once that work passes inspection, the city may issue an Occupancy Permit for the secondary suite.

The Saskatchewan Secondary Suite Incentive Grant

The Saskatchewan Secondary Suite Incentive (SSI) is a provincial grant covering 35 percent of the total cost to construct a new secondary suite at a homeowner’s primary residence, up to a maximum of $35,000 per qualifying suite. To qualify, the suite must be a new, self-contained unit with a full kitchen, full bathroom, and separate entrance that meets all applicable codes.

Eligible costs under the SSI grant include:

  • Construction materials used to build the suite
  • Contract labor for construction work
  • Professional design services tied to the project
  • Standard appliances up to $5,000

Eligible costs must be incurred between April 1, 2023, and March 31, 2027, with construction completed and applications received by the Ministry of Finance by December 31, 2027. Only one secondary suite per homeowner’s primary residence qualifies. We recommend confirming current program terms directly with the Ministry of Finance, as provincial program rules can change.
